1. About these terms
These terms are an agreement between you and [TO CONFIRM legal entity name], of [TO CONFIRM registered address] ("Petro", "we", "us"). They cover every part of the Petro service: the mypetro.lk website, the web console each station or company uses at its own address on mypetro.lk, and the Petro Owner mobile app.
If you use Petro for a station, company or co-operative (the "customer"), you accept these terms on its behalf and confirm you are allowed to. If you do not accept them, do not use the service.
A written agreement signed with a customer takes priority over these terms where the two differ.
2. The service
Petro is online software for running a fuel station's operations and accounts. Each customer gets its own Petro site. We may offer a free trial; the trial's length and limits are those shown when you sign up.
We keep improving Petro, so features may change. If we remove a feature that a paying customer relies on, we will tell the customer before we do.
3. Accounts
- Give accurate information when you sign up and keep it up to date.
- Keep your password to yourself. You are responsible for what is done with your account.
- The customer's administrators decide who has access to its site and with which role, and are responsible for removing access when someone leaves.
- Tell us straight away if you think someone has used an account without permission.
4. The customer's responsibilities
- The customer is responsible for the data it enters being accurate and for having the right to enter it, including giving its staff, customers and suppliers any notice or getting any consent the law requires.
- Petro helps a customer keep its books, but the customer stays responsible for its own accounts, tax returns, and legal and regulatory duties, and for checking the figures Petro produces.
- The customer is responsible for what its users do in its site.
5. Acceptable use
You must not:
- use Petro for anything unlawful or fraudulent;
- try to reach another customer's data, or any part of the service you have not been given access to;
- test, probe or get around the service's security, or put malicious code into it;
- overload the service or interfere with other customers' use of it;
- copy, resell or reverse-engineer the service, except where the law expressly allows it.
We may suspend an account that breaks these rules, and will tell the customer why.
6. Your data
The customer owns the business data it puts into Petro. The customer lets us host, process, copy and back it up only as needed to provide, secure and support the service for it.
We handle personal data as our Privacy Policy describes. While a subscription is active, the customer can export its data in the formats the service supports.
7. Subscriptions and billing
- Petro is a subscription for each customer site.
- Fees are those agreed with the customer in writing or, if none were agreed, those published on mypetro.lk when the subscription starts or renews.
- We invoice for each billing period. Each invoice shows its amount and due date. Taxes are added where the law requires.
- We may change our fees. We will give the customer at least [TO CONFIRM notice period for fee changes] notice, and a change applies from the next billing period after the notice ends.
- Refunds: [TO CONFIRM refund policy, if any]
8. Suspension for non-payment
If an invoice is still unpaid [TO CONFIRM number of days] after its due date, we may suspend the customer's access after telling the customer. We restore access once the overdue amount is paid. Suspension does not by itself delete the customer's data, but if the invoice stays unpaid we may end the subscription under section 9.
9. Cancellation and termination
- A customer can cancel its subscription at any time by telling us, giving [TO CONFIRM cancellation notice period] notice. Cancellation takes effect at the end of the billing period in which the notice ends.
- We can end a subscription if the customer seriously breaks these terms and does not put it right after we tell it to, or if invoices stay unpaid after suspension.
- When a subscription ends, the customer has [TO CONFIRM export window length] to export its data. After that we delete the customer's site and its data, as our Privacy Policy describes.
10. Intellectual property
We own Petro: the software, its design, the Petro name and logo, and our documentation. While a subscription is active, the customer and its users may use the service for the customer's own business. Nothing in these terms transfers ownership of Petro to anyone else.
If you send us suggestions, we may use them without owing you anything.
11. Other services
Petro relies on services we do not control, such as internet and mobile networks, app stores and banks. Their own terms apply to them, and we are not responsible for them.
12. Availability and disclaimers
We work to keep Petro available and correct, but we do not promise it will be uninterrupted or free of errors. We may need to take it offline for maintenance, and will try to do so at quiet times.
Reports and figures in Petro are only as accurate as the data entered. Petro is not accounting, tax or legal advice. To the extent the law allows, the service is provided as it is, without promises beyond those in these terms.
13. Limitation of liability
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill.
- Our total liability to a customer for all claims is limited to [TO CONFIRM liability cap].
- Nothing in these terms limits liability that the law does not allow to be limited.
The customer is responsible for claims made against us because of data it entered unlawfully or because it broke these terms.
14. Governing law
These terms are governed by the laws of Sri Lanka. Disputes go to the courts of [TO CONFIRM courts with jurisdiction].
15. Changes to these terms
We may update these terms. The date at the top of the page shows when they last changed. We will tell customers about a significant change at least [TO CONFIRM notice period for changes to the terms] before it takes effect. Continuing to use Petro after that means accepting the new terms.
